ITAC, NRCS & SARS Notices And Tariff Amendments

The following Notices has been received:

  • Notice 3734 – ITAC’S SELF-INITIATED INVESTIGATION ON SUGAR CLASSIFIABLE UNDER TARIFF HEADING 17.01 AND THE APPROPRIATE LEVEL OF THE DOLLAR-BASED REFERENCE PRICE (“DBRP)

ITAC has undertaken a self-initiated review:

  1. The South African Sugar Association (“SASA”) applied for an increase in the current DBRP fromUS$680/ton to US$905/ton, citing amongst other reasons, the need to protect the local sugar industry and ensure its sustainability.
  2. Subsequently, the Beverage Association of South Africa (“BEVSA”) applied for a reduction in the current DBRP from US$680/ton to between US$552/ton and US$650/ton, citing amongst other reasons, the adverse impact of current duties on beverage producers, bottlers, consumers, etc.
  3. Subsequently, the Beverage Association of South Africa (“BEVSA”) applied for a reduction in the current DBRP from US$680/ton to between US$552/ton and US$650/ton, citing amongst other reasons, the adverse impact of current duties on beverage producers, bottlers, consumers, etc.

ITAC has undertaken a self-initiated review and combined evaluation based on the two applications.

  • Notice 53984 / R.7018 – Imposition of provisional payments in relation to anti-dumping duties against the alleged dumping of 3 mm, 4 mm, 5 mm and 6mm clear float glass classifiable under tariff subheadings 7005.29.17, 7005.29.23, 7005.29.25, and 7005.29.35, originating in or imported from Tanzania (ITAC Report No. 762)

The imposition of the Provisional Payment in relation to anti-dumping duties are based on the following criteria:

  1. Float glass and surface ground or polished glass, in sheets, whether or not having an absorbent, reflecting or non-reflecting layer, but not otherwise worked, of a thickness exceeding 2,5 mm but not exceeding 3mm (excluding solar glass and optical glass), manufactured by KEDA
  2. Float glass and surface ground or polished glass, in sheets, whether or not having an absorbent, reflecting or non-reflecting layer, but not otherwise worked, of a thickness exceeding 2,5 mm but not exceeding 3mm (excluding solar glass and optical glass), manufactured by all other manufacturers (excluding that manufactured by KEDA Ceramics Company Limited)
  3. Float glass and surface ground or polished glass, in sheets, whether or not having an absorbent, reflecting or non-reflecting layer, but otherwise not worked, of a thickness exceeding 3 mm but not exceeding 4 mm (excluding solar glass and optical glass), manufactured by KEDA Ceramics Company
  4. Float glass and surface ground or polished glass, in sheets, whether or not having an absorbent, reflecting or non-reflecting layer, but otherwise not worked, of a thickness exceeding 3 mm but not exceeding 4 mm (excluding solar glass and optical glass), manufactured by all other manufacturers (excluding that manufactured by KEDA Ceramics Company Limited)
  5. Float glass and surface ground or polished glass, in sheets, whether or not having an absorbent, reflecting or non-reflecting layer, but not otherwise worked, of a thickness exceeding 4 mm but not exceeding 5 mm (excluding solar glass and optical glass), manufactured by KEDA Ceramics Company
  6. Float glass and surface ground or polished glass, in sheets, whether or not having an absorbent, reflecting or non-reflecting layer, but not otherwise worked, of a thickness exceeding 4 mm but not exceeding 5 mm (excluding solar glass and optical glass), manufactured by all other manufacturers (excluding that manufactured by KEDA Ceramics Company Limited)
  7. Float glass and surface ground or polished glass, in sheets, whether or not having an absorbent, reflecting or non-reflecting layer, but not otherwise worked, of a thickness exceeding 5 mm but not exceeding 6 mm (excluding solar glass and optical glass), manufactured by KEDA Ceramics Company Limited
  8. Float glass and surface ground or polished glass, in sheets, whether or not having an absorbent, reflecting or non-reflecting layer, but not otherwise worked, of a thickness exceeding 5 mm but not exceeding 6 mm (excluding solar glass and optical glass), manufactured by all other manufacturers (excluding that manufactured by KEDA Ceramics Company Limited)
